Free Wi-Fi Terms of Service

By connecting to and using the Dr Mark Irving guest Wi-Fi network (“Wi-Fi”), you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Wi-Fi.

1) Who provides this Wi-Fi

  • This Wi-Fi is provided by Dr Mark Irving (the “Practice”) for short-term guest use at our premises.

2) Acceptable use

You agree to use the Wi-Fi responsibly and lawfully. You must not use the Wi-Fi to:

  • Break any law or regulation

  • Access, transmit, or store content that is unlawful, abusive, threatening, harassing, defamatory, or otherwise inappropriate

  • Attempt to gain unauthorised access to any system, device, account, or network

  • Interfere with other users or disrupt the network (including scanning, probing, flooding, or introducing malware)

  • Send spam, bulk messages, or run automated services

  • Download or distribute copyrighted material unlawfully

  • Conduct business activities that materially impact network performance (for example, large file uploads, crypto mining, or continuous streaming)

  • We may block or restrict access to protect the Wi-Fi and our patients, staff, and systems.

3) No guarantee of availability or speed

This Wi-Fi is provided on an “as is” and “as available” basis. We do not guarantee:

  • continuous availability

  • minimum speeds or performance

  • uninterrupted access

  • that the Wi-Fi will meet your needs

  • Access may be limited, suspended, or withdrawn at any time without notice.

4) Security and your responsibility

Guest Wi-Fi is a shared public network. While reasonable measures may be taken to maintain security, you acknowledge:

  • the Wi-Fi may not be secure

  • data transmitted over Wi-Fi could potentially be intercepted by third parties

  • you use the Wi-Fi at your own risk

  • You are responsible for protecting your own devices and information, including by using up-to-date software, antivirus protection, strong passwords, and (where appropriate) a VPN.

5) No medical advice

  • Access to the Wi-Fi does not create a clinician–patient relationship and does not provide medical advice. If you require clinical guidance, please speak with our team directly.

6) Monitoring and network management

To help keep the Wi-Fi stable and safe, we may use network management tools that record limited technical information, such as:

  • device identifiers (for example, MAC address)

  • IP address assigned during the session

  • connection times and usage volume

  • security events and diagnostics

We do not actively monitor the content of what you view or type, however network logs may be reviewed if we suspect misuse, unlawful activity, security threats, or interference with the service.

Personal information (if any) will be handled in accordance with our Privacy Policy:

8) Limitation of liability

To the maximum extent permitted by law, the Practice is not liable for any loss, damage, cost, or claim arising from or related to your use of the Wi-Fi, including (but not limited to):

  • device or data loss

  • malware, hacking, or unauthorised access

  • service interruptions

  • financial loss or loss of business

  • content accessed via the internet

  • Nothing in these Terms excludes any rights you may have under the Australian Consumer Law, which cannot be excluded.

9) Indemnity

  • You agree to indemnify the Practice against any loss, damage, cost, or claim (including legal costs) arising from your misuse of the Wi-Fi or breach of these Terms.

10) Changes to these Terms

  • We may update these Terms from time to time. The latest version will be available on the captive portal.
